Overview on remote work regulations in the United States of America

The Fair Labor Standards Act (FLSA) and its implementing regulations do not prevent employers from implementing telework or other flexible work arrangements allowing or requiring employees to work from home. Employers are required to maintain an accurate record of hours worked for all employees鈥攊ncluding those participating in telework or other flexible work arrangements.

Employer must also pay no less than minimum wage for all hours worked and to pay at least one and one-half times the employee鈥檚 regular rate of pay for all hours worked more than 40 in a workweek to non-exempt employees. 10 states currently have their own work from home allowance laws in place on top of federal laws.
